Microjuris.com User Agreement


This User Agreement between the Authorized User ("You") and microjuris.com ("microjuris.com") regulates the use of microjuris.com´s Web Site ("Site"), which includes any content, functions, or services ("Products") accessible directly on the Site. Your use of the Site and the Products is subject to the terms and conditions stated herein.

PLEASE READ THIS USE AGREEMENT CAREFULLY BEFORE USING THIS SITE.

In using this Site or any other Web Site that is the property of microjuris.com, you agree to abide by the conditions of this User Agreement. Other standards regulating your use of the Site may be sent through online messages along with certain products (known jointly as "Additional Rules"). Your use of any Product regulated by the Additional Rules shall constitute your acceptance of the respective Additional Rules. If you do not agree with the Additional Rules, please refrain for using the Product in question.

Relation between the client and microjuris.com

Neither microjuris.com nor the individuals or organizations that may be the source of some Product that is distributed or sold on the Site are dedicated to the legal practice. The Products that appear on the Site are offered as sources of information and do not constitute legal advice from microjuris.com. The access to, transmission, or receipt of Products from the microjuris.com Site does not create an attorney-client relation between You or any other person and microjuris.com.

The use of the Products contained on the microjuris.com Site may require the help of experts in the legal profession to provide you a legal opinion. If You believe that you can make a legal claim, we suggest that you contact an attorney who is authorized to practice Law in your respective jurisdiction.

Licence

Upon accepting the terms stated in this User Agreement and paying the fees corresponding to your access account to microjuris.com, You receive a limited, nontransferable, and nonexclusive license to use the Products available at microjuris.com. Access to some Products may be restricted. Your license consists of the right to transfer or save copies of the Products for a period of 18 months from the date of the transfer, for the exclusive purpose of:
  1. viewing the Product for your own information;
  2. printing the contents of the Product for your own use;
  3. copying, quoting, or selecting portions of the Product through the use of electronic cut and paste, or any other method, in creating a written document.
It is strictly forbidden to copy, transfer, save, publish, transmit, sell, or use the Products without proper written approval from microjuris.com, or in violation of the User Agreement or the Copyright Act" (17 U.S.C.A. §107). The sale, licensing, or distribution of the Products (including printing the Products) to third parties is prohibited. The multiple reproduction of copies of the Products, either printed or in any other format, is prohibited.

If You are not an attorney, the use the Products for any purpose other than to obtain general information is expressly prohibited.

Microjuris.com trademark

Except for the license in the User Agreement, all rights, titles, and interest in the Site and the Products (including all trademarks and other copyrights), in all languages, formats, and media worldwide, are and will continue to be the exclusive property of microjuris.com and its partners.

It is forbidden to decompile, disassemble, reverse engineer, lease, lend, license, or create unauthorized systems derived from the microjuris.com Site. The reproduction, modification, distribution, transmission, or use of the Site or the Products for commercial or other purposes in violation of the terms stated herein is expressly prohibited.

Nondisclosure Statement or Guarantee

Neither microjuris.com nor its partners guarantee or make statements suggesting that the Products are appropriate or are designed for use in a jurisdiction outside the local one. You make use of the Web Site and of the Products at your own risk and are responsible for complying with local laws that apply to the use of the Site and the Products.

microjuris.com´s database is not all-inclusive and, by involuntary omission, may not contain some legal document that you are seeking. If You are not an attorney, the use the Products for any purpose other than to obtain general information is expressly forbidden.

Responsibility

Neither microjuris.com nor its partners assume the responsibility for the use or interpretation of its Products. The Site and the Products are offered as they are without any type of guarantee, expressly or implicitly. There is no guarantee of performance, specificity, involuntary tasks, or update. microjuris.com reserves the right, at its discretion, to modify, improve, add, or eliminate any part of the Site, including the Products, at any moment, as necessary or pertinent.

Single Remedy

The Single and Exclusive Remedy that would correspond to You under this User Agreement for any claim due to damages, if any, from the use of the Site or the Products, will be equivalent to the total cash paid by you under this service contract during the twelve (12) months prior to the event that originated said claim.

Neither microjuris.com nor its affiliates or partners shall be responsible for claims related to your inability or unsuccessful attempts to conduct searches on the Site or for the use inability to use the Site.

Access to the microjuris.com Web Site

Neither microjuris.com nor its partners guarantee the access to the Site against interruptions, security flaws, or involuntary content errors. Access may be affected by mechanical defects, and this may cause errors, delays, interruptions, and even the loss of information. The microjuris.com Site and the Products may be affected by causes beyond our control, such as natural disasters, government actions, war of armed conflict, civil disorder, acts of nature, fire, explosion, electrical failures, labor disputes, etc.

The microjuris.com Site contains electronic links to other resources that are accessible through the Internet. These links are provided only as suggestions to help in your search for information that may be of interest to You. Neither microjuris.com nor its partners are special sponsors or affiliates of these Internet Web Sites.

You may suggest or recommend the electronic address of the microjuris.com Site as a link from other Internet Sites, as long as you comply with the following requirements:

  2. the link does not eliminate or hinder access to microjuris.com´s User Agreement;
  3. you notify microjuris.com that you will implement the link;
  4. terminate the link immediately if microjuris.com requests it.
Modifications to the User Agreement

microjuris.com reserves the right, at its discretion, to modify this User Agreement at any time. We advise that you review the User Agreement periodically on the Site to see these changes. The amendments to this User Agreement are accessible on the Site and will enter into effect the moment they are published. Your use of the Site after changes are published in the User Agreement shall be considered as your acceptance of the amended Agreement.

Access to the microjuris.com password

The access and use of restricted areas, protected by a secret password on the Site, is for the exclusive use of Authorized Users.
  • IT IS EXPRESSLY PROHIBITED TO SHARE YOUR USER CODE AND PASSWORD WITH OTHER PERSONS. UNAUTHORIZED INDIVIDUALS WHO ATTEMPT TO ACCESS THE SITE´S RESTRICTED AREAS ARE SUBJECT TO CRIMINAL AND CIVIL PENALTIES.
  • YOU ARE RESPONSIBLE FOR SAFEGUARDING YOUR USER CODE AND PASSWORD IN A SECURE AND CONFIDENTIAL MANNER.
  • YOU ARE RESPONSIBLE FOR THE ACCESS AND USE OF THE PRODUCTS BY ANY INDIVIDUAL OR ORGANIZATION WHO USES YOUR PASSWORD TO ENTER THE SITE, EVEN WHEN YOU ARE UNAWARE.
  • TRANSFERRING OR LICENSING THE USER AGREEMENT OR ANY OF ITS PARTS TO THIRD PARTIES WITHOUT THE CONSENT OF microjuris.com IS PROHIBITED.
Termination

Upon expiration your contract with microjuris.com, You may terminate the right to have access by means of a written notification to microjuris.com. In case You do not notify microjuris.com of your decision to terminate the contract, the same will remain in force from month to month. Your access and privileges under the User Agreement may be terminated immediately and without prior notification if you violate any of the terms and conditions of the User Agreement. microjuris.com and its partners may seek legal remedies at their disposal if you violate any of the terms of the User Agreement. Persons who use the Site to infringe upon the copyright and trademark of others may be disconnected from the microjuris.com service without being granted the right to a reimbursement of their money.

Failure by microjuris.com to enforce any provision of the User Agreement does not constitute an impediment for microjuris.com to exercise its right to enforce it afterward.

You cannot assign to others the rights and duties contained in the User Agreement. If any part of the User Agreement were to be declared invalid or illegal, the parties agree that the rest of the parts of the Agreement will not be affected, and that the User Agreement will remain valid and executable.

Applicable Law

This Web Site is the property of and is controlled by microjuris.com, Inc., a corporation that is incorporated in Delaware, U.S.A., and with central offices in San Juan, Puerto Rico. The Site is available on the Internet to any person anywhere on the planet. Since the local laws of each country vary, you agree that any matter leading to a conflict of principles of law regarding the use of the Site or the Products, shall be resolved under the statutes and laws on the Commonwealth of Puerto Rico.

Any controversy or claim arising due to the User Agreement shall be resolved by means of arbitration, following the specifications of the American Arbitration Association (A.A.A.). The arbitration shall be carried out in a court under the jurisdiction of Puerto Rico.

Representation of the User

You certify and guarantee that: (a) the information that you provided to microjuris.com is true and correct; (b) you vow to obey the laws, rules, and regulations applicable to the correct use of the Site and the Products; (c) you vow to obey the terms and conditions of the User Agreement at all times, including any other additional term, in accordance with any amendment that microjuris.com may institute to such effects.

Language Translation Disclaimer

The Microjuris.com website provides an optional service of automatized language translation. Microjuris.com has made reasonable technological efforts in order to provide accurate translations. However, no automatized or computerized translation is 100% accurate and is not intended to replace or substitute traditional or certified translation methods.
